Terms of Service

These Terms of Service (“Terms”) govern your use of the website https://www.getoutpostsystems.com, your communications with Outpost Systems LLC (“Outpost Systems,” “we,” “us,” or “our”), and the services we provide to you.
Please read these Terms carefully. They work together with our Privacy Policy, available at https://www.getoutpostsystems.com/privacy-policy.
1. Agreement to Terms
By visiting our website, submitting a form, booking a call, completing our onboarding intake form, opting in to text messages, or engaging Outpost Systems to perform services, you agree to these Terms. If you do not agree, please do not use our website or our services.
If you are entering into these Terms on behalf of a company, you represent that you are an authorized representative of that company and that you have authority to bind it.
You must be at least 18 years old to request services or to opt in to our communications.
Where you and Outpost Systems sign a separate proposal, order form, or service agreement, that document controls if it conflicts with these Terms. These Terms govern everything the signed document does not address.
2. Description of Services
Outpost Systems LLC is a Wyoming limited liability company that builds and manages marketing, communication, and automation systems for home service contractors and other local service businesses. Depending on your plan, our services may include:
- Website design, build, and hosting management
- Setup and administration of a customer relationship management and automation platform
- Business phone number provisioning, call routing, and automated call answering or message taking
- Missed-call follow-up, lead capture, and appointment booking automation
- Email, text message, and voicemail campaign setup and management
- Review generation and online reputation workflows
- Assistance preparing and submitting A2P 10DLC brand and campaign registrations on your behalf
- Migration of existing customer lists, calendar events, and templates into your new system
- Onboarding, training, and ongoing support
What we do not do. We do not provide legal, tax, accounting, or licensing advice. We do not act as your registered agent. We do not guarantee any specific number of leads, calls, bookings, jobs, revenue, or search ranking. We do not perform the trade services our clients sell to their own customers, and we are not a party to any agreement between you and your customers.
Scope. The specific deliverables, timeline, and fees for your engagement are set out in your proposal, order form, or onboarding intake form. Work outside that scope requires a written change order and may affect price and timeline.
3. User Responsibilities
When you use our website or engage our services, you agree to:
- Provide accurate, current, and complete information, including your legal business name, entity type, EIN, business address, licensing details, and contact information
- Provide only phone numbers and email addresses that belong to you or that you are authorized to provide
- Supply the assets and information we need to build your system, including logos, photographs, service details, pricing, and account access, in a timely manner
- Maintain any licenses, registrations, insurance, and permits required for your trade
- Review and approve deliverables within a reasonable time when we request approval
- Keep your account credentials secure and notify us promptly of any suspected unauthorized access
- Pay fees in accordance with Section 6
Delays. Our timelines assume timely responses from you. Delays in providing assets, approvals, or access will extend delivery dates. Fees for recurring services continue to accrue during client-caused delays.
4. Your Data, Your Consent Obligations
Your data belongs to you. Customer lists, contact records, conversation history, calendar events, and content you provide or generate through systems we build remain your property. You retain ownership of any domain name you own, and you keep it when our engagement ends. On termination, we will provide a reasonable export of your contact and conversation data as described in Section 13.
You are responsible for the consent behind your data. This is the most important obligation in these Terms. You represent and warrant that:
- Every phone number and email address you upload, import, or provide to us was collected lawfully and with the consent required by applicable law
- You have obtained prior express written consent, as defined by the Telephone Consumer Protection Act, before any marketing text message or automated call is sent to a number on your list
- You will honor every opt-out request promptly and will not re-add a number that has opted out
- Your website displays a privacy policy and terms of service that meet carrier and regulatory requirements before any messaging campaign goes live
- The information you provide for A2P 10DLC brand and campaign registration, including your legal name, EIN, and address, is accurate and matches your official records
You are the sender of record for messages sent from your account. Outpost Systems configures and administers the system; you control who is messaged and on what basis. You are solely responsible for the content of your messages and for the legality of your contact lists.
Carrier approval is not guaranteed. We will prepare and submit registrations carefully and will work through rejections with you, but carriers and aggregators make their own approval decisions. We do not control and cannot guarantee brand approval, campaign approval, throughput, message deliverability, or the timeline for any of them.
Suspension for compliance risk. We may suspend or disable messaging on your account immediately, without refund, if we receive a carrier complaint, detect spam or high opt-out rates, or reasonably believe your list or message content violates applicable law or carrier rules.
5. Acceptable Use
You agree not to:
- Use our website, our services, or any system we build for any unlawful purpose
- Send messages to any person who has not given the consent required by law, or who has opted out
- Send messages promoting content prohibited by carriers, including cannabis, illegal substances, firearms where restricted, high-risk financial offers, gambling, or adult content
- Submit false, fraudulent, or misleading information in any form or registration
- Attempt to gain unauthorized access to our website, our platform, another client's sub-account, or any connected system
- Interfere with, disrupt, overload, or attempt to disable our website or systems
- Use automated tools to scrape, harvest, or copy content or contact data from our website or platform
- Resell, sublicense, or provide access to systems we build for you to any other business without our written consent
- Send abusive, threatening, harassing, or discriminatory messages to our team
We may suspend or terminate access to our website, our messaging program, or our services for any violation of this section.
6. Payments and Billing
Fees. Setup fees, monthly subscription fees, and any usage-based charges are set out in your proposal, order form, or onboarding documents.
Payment processing. Payments are processed through Stripe. Card and bank details are entered directly into Stripe's secure environment. Outpost Systems does not store full payment card numbers.
Recurring billing. Monthly and other recurring fees are billed in advance on the schedule stated in your agreement and continue until cancelled in accordance with Section 13. By providing a payment method, you authorize us to charge it for all fees due.
Setup fees. Setup and build fees cover work performed and are non-refundable once work has begun.
Usage charges. Certain costs, including phone number rental, call minutes, text message segments, and email sends, are usage based and may be billed as incurred or passed through at cost.
Failed and late payments. If a payment fails, we may retry the charge and will notify you. Accounts more than 10 days past due may have services suspended, including websites, phone numbers, and messaging, until the balance is paid. Suspension does not stop recurring fees from accruing.
Taxes. Fees are exclusive of applicable taxes, which are your responsibility.
Price changes. We may change our fees on 30 days' written notice. If you do not accept a price change, you may cancel before it takes effect.
7. Intellectual Property
Our property. All content on https://www.getoutpostsystems.com, our brand name and logo, our proprietary templates, workflow structures, automation blueprints, prompts, scripts, training materials, and processes are owned by Outpost Systems LLC and are protected by applicable intellectual property law. Nothing in these Terms transfers ownership of these materials to you.
Your license. For the duration of your paid engagement, we grant you a non-exclusive, non-transferable license to use the systems, templates, and automations we configure for you, solely for your own business.
Your property. Your business name, logo, photographs, copy, customer data, and domain name remain yours. You grant us a limited license to use those materials solely to build and operate your systems during the engagement.
Portfolio use. We may reference your business name and display screenshots or results from work we performed for you in our own marketing, unless you tell us in writing that you prefer we do not.
8. Communications and Consent
Outpost Systems uses the GoHighLevel platform to manage client communications, contact records, forms, appointment calendars, and automation workflows. Depending on the information you provide and the consent you give, you may receive emails, phone calls, voicemail messages, and text messages from Outpost Systems through this system.
We do not send text messages without your prior express consent. Consent for non-marketing messages and consent for marketing messages are collected separately, and you may give one without the other. Details on how we handle your information are set out in our Privacy Policy at https://www.getoutpostsystems.com/privacy-policy.
9. SMS Messaging Terms
By opting in to the Outpost Systems text messaging program, you agree to the terms in this section.
Types of messages you will receive
Outpost Systems sends text messages related to your account and your engagement with our company. These include onboarding steps and reminders, requests for information or assets needed to build your system, appointment and call confirmations, launch and go-live notices, support responses, system and outage alerts, billing and payment notifications, and account updates. If you separately opt in to marketing messages, you will also receive special offers, discounts, new service and feature announcements, and occasional company updates.
Opt-out instructions
You can cancel the SMS service at any time. Just text “STOP” to (850) 805-4003. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carrier liability
Carriers are not liable for delayed or undelivered messages.
Message and data rates
As always, message and data rates may apply for any messages sent to you from us and to us from you.
Message frequency
You will receive messages based on your account activity, typically several messages per week during onboarding and fewer once your system is live, and marketing messages no more than a few times per month if you have opted in to receive them. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
Consent is not a condition of purchase
Consent to receive text messages is not a condition of purchasing any goods or services from Outpost Systems.
Consent is not shared
Text messaging originator opt-in data and consent will not be shared with any third parties, except for aggregators and providers of the Text Message services. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

10. Disclaimers
Our website, our platform, and our services are provided on an “as is” and “as available” basis. Outpost Systems makes no warranty that they will be uninterrupted, error free, or free of harmful components.
No results guarantee. Marketing and automation outcomes depend on your market, your pricing, your responsiveness, your reputation, and factors outside our control. We do not guarantee any specific number of leads, calls, booked jobs, conversions, revenue, search ranking, or return on investment. Examples and case studies are illustrative and are not a promise of similar results.
Third-party platform dependence. Our services rely on third-party platforms including GoHighLevel, telecommunications carriers and aggregators, payment processors, hosting providers, and advertising platforms. We are not responsible for outages, policy changes, price increases, feature removals, account suspensions, or approval decisions made by those platforms.
Automated call and message handling. Automated assistants, voicemail transcription, and AI-assisted responses can make errors. You are responsible for reviewing messages and voicemails captured by these systems and for following up with your customers.
Except where a warranty cannot be disclaimed under applicable law, Outpost Systems disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by law, Outpost Systems LLC, its members, officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost business, lost leads, loss of data, or reputational harm, arising out of or related to our website, our communications, or our services.
Our total aggregate liability for any claim arising out of or related to these Terms or our services is limited to the total amount you paid Outpost Systems in the three months immediately preceding the event giving rise to the claim.
This section does not limit liability for gross negligence, willful misconduct, or any liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Outpost Systems LLC, its members, officers, employees, and contractors from any claim, loss, liability, damage, fine, penalty, cost, or expense, including reasonable attorneys' fees, arising out of:
- Your breach of these Terms
- Any claim that messages sent from your account violated the Telephone Consumer Protection Act, CAN-SPAM, state telemarketing law, or carrier rules
- Contact data you provided that was collected without required consent
- Inaccurate information you supplied for A2P 10DLC registration or any other filing
- Content, offers, claims, or pricing you asked us to publish or send
- Your violation of any law or the rights of any third party
- Services you performed for your own customers
13. Termination
By you. You may cancel recurring services by giving written notice at least 30 days before your next billing date, unless your signed agreement states a different notice period or minimum term. Fees already paid are non-refundable, and any committed minimum term remains payable.
By us. We may suspend or terminate your account if you breach these Terms, fail to pay, provide false registration information, generate carrier complaints, or subject our team to abusive conduct. We may also discontinue a service on 30 days' written notice, in which case we will refund any prepaid fees for the undelivered period.
On termination. We will provide a reasonable export of your contact records and conversation history on request made within 30 days of termination. You keep your domain name. Phone numbers may be ported to another provider at your request where the carrier permits, and you are responsible for any porting fees. Access to our proprietary templates, workflows, and automations ends with the engagement. After 30 days, we may remove your data from systems we administer in accordance with our Privacy Policy.
Sections 4, 7, 10, 11, 12, and 14 survive termination.
14. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or our services will be brought exclusively in the state or federal courts located in Laramie County, Wyoming, and you consent to the jurisdiction of those courts.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver of it.
15. Changes to Terms
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date below and post the current version at https://www.getoutpostsystems.com/terms. Material changes affecting active clients will be communicated by email or text where appropriate. Your continued use of our website, our messaging program, or our services after an update constitutes acceptance of the revised Terms.
